1. Introduction
Welcome to US Beauty Award (“we”, “US Beauty Award”, “the Site”). These Terms of Use (“Terms”) govern your access to and use of the Site, platform, services, content, events, nomination/voting programs and all related features. By accessing or using the Site you agree to these Terms and any linked policies. If you do not agree, do not use the Site.
2. Eligibility and Account Registration
2.1 Minimum Age:
You must be at least 18 years old to register and use our services. If under 18, you may use the Site only with the consent and supervision of a parent or legal guardian.
2.2 Registration Information:
When creating an account you must provide accurate, complete and up-to-date information. You are responsible for all activity under your account.

3. US Beauty Award Rights and Obligations

US Beauty Award provides an information platform, nomination/voting systems, award listings, events and related services. We may modify, suspend, or discontinue any part of the services for maintenance, legal compliance, or operational reasons without prior notice.
3.2 Maintenance and Upgrades:
We may perform scheduled maintenance. We will endeavor to notify users in advance of significant service impacts.
3.3 Final Decisions:
In case of disputes related to nominations or voting results, US Beauty Award retains final decision authority unless otherwise specified in a separate policy.
4. Intellectual Property and Content
4.1 Copyright and Ownership:
All Site content produced or licensed by US Beauty Award (including text, images, video, logos, icons, layout, code and design) is owned by US Beauty Award or its licensors. Copying, distributing, modifying or commercial use is prohibited without written permission.
4.2 Limited License to Users:
We grant you a limited, non‑exclusive, non‑transferable right to access and use Site content for personal, noncommercial purposes as allowed on the Site. All other rights are reserved.
4.3 Infringement Claims:
If you believe your intellectual property has been infringed on the Site, submit a notice per our contact instructions; we will investigate and act in accordance with applicable law.
5. User‑Generated Content
5.1 Responsibility for Uploads:
You may upload images, articles, reviews, nominations and other content. By uploading you warrant that (a) you own or are authorized to use the content; (b) the content does not infringe third‑party rights; and (c) the content is lawful and not defamatory, threatening, discriminatory, pornographic, fraudulent or otherwise prohibited.
5.2 Grant of License to US Beauty Award:
By submitting content you grant US Beauty Award a worldwide, non‑exclusive, royalty‑free, sublicensable right to use, reproduce, modify, publish, distribute, display and otherwise exploit your content for Site operations and promotional activities.
5.3 Moderation and Removal:
US Beauty Award is not responsible for user content but reserves the right to review, edit, refuse or remove any content that violates these Terms or our internal policies without prior notice.
5.4 Indemnity:
You agree to indemnify and hold US Beauty Award harmless from any claims, liabilities or expenses arising from your content or your violation of these Terms.
6. Award Ownership and Use Rights
6.1 Usage Term:
Any award conferred by US Beauty Award (including badges, certificates, logos, and the right to use the title “US Beauty Award” or similar) is licensed to the recipient for a period of one (1) year, starting from the date the recipient receives an official verification email from US Beauty Award confirming the award.
6.2 Scope and Limitations:
The license permits display of the badge/certificate and statements such as “Winner/Selected by US Beauty Award” in marketing or promotional materials only in a manner that does not imply US Beauty Award endorses or is responsible for the recipient’s business operations. Use of US Beauty Award trademarks must follow any brand guidelines provided and may not be altered without written permission.
6.3 Expiration and Termination:
Rights to use award-related marks and titles automatically expire after one year from the verification email date unless extended by a written agreement. Continued use after expiration may result in a cease-and-desist request, claims for damages, and other legal remedies.
6.4 Revocation:
US Beauty Award may revoke or invalidate any award if it determines the recipient engaged in fraud, violated these Terms, engaged in unethical behavior, or provided false information. Revocation takes effect upon notification by US Beauty Award.
7. Nomination and Voting Process — Transparency and Accountability
7.1 Management Responsibility:
All nomination, review, voting, scoring and result publication processes are established, managed and overseen by US Beauty Award. We commit to transparency and fair procedures and implement controls to reduce fraud.
7.2 Published Rules:
Rules, criteria, timelines, participation methods and scoring methods will be published clearly before each campaign. Major changes will be announced in advance with effective dates.
7.3 Protection of Voting Data:
US Beauty Award will protect voting records and related information per our privacy practices, but cannot guarantee absolute protection against sophisticated interference.
7.4 Complaints:
Participants and stakeholders may submit complaints about process or results; US Beauty Award will investigate and respond per internal policy. Final decisions after internal review rest with US Beauty Award unless legal requirements dictate otherwise.
8. Payments, Fees and No‑Refund Policy
8.1 Paid Services:
Certain services (premium accounts, advertising, participation packages, event tickets, etc.) may require payment. Fees, payment methods and terms will be disclosed at the time of transaction.
8.2 No Refunds:
Except where a written agreement states otherwise or as required by law, all fees, charges and payments for services, registrations or participation are non‑refundable. Refund requests due to errors caused by US Beauty Award may be considered at our discretion.
8.3 Taxes and Charges:
Any applicable taxes, duties or fees arising from transactions are the responsibility of the purchaser as required by law.

10.3 Maximum Liability:
In no event shall US Beauty Award’s aggregate liability exceed the fees actually paid by you to US Beauty Award in the preceding 12 months (if any), or such minimum amount as applicable law may require.

12. Suspension and Termination

US Beauty Award may suspend or terminate your account, access or services if you breach these Terms, engage in fraud or harmful behavior, or upon legal request.
12.2 Effect of Termination:
Upon termination, access to content and services may be revoked. Sections regarding indemnity, limitation of liability and other provisions intended to survive termination shall remain in effect.
13. Indemnification
You agree to indemnify, defend and hold US Beauty Award and its officers, directors, employees, agents and partners harmless from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms; (b) your user content; (c) your fraudulent or unlawful conduct; or (d) third‑party claims related to your use of the Site.
